As Employer Agents, we believe it is our moral and ethical obligation to assist our clients to the best of our ability, to be in Compliance with the program being participated in.
Regardless of anything an agent, or an attorney may tell an H2 Employer;
it is ultimately the responsibility of the Employer to follow employment laws and the rules of the program. This has been clearly stated by U.S. Department of Labor/Wage and Hour Division Agents on multiple occasions.
We will soon begin a series of Blog posts related to Compliance for both the H2A and the H2B Programs. We will attempt to make it as reader friendly as possible. It is important that H2 Employers fully understand their obligations.
We would urge all H2 Employers to please feel free to verify the information we are providing, and to please follow the law. Non-compliance only increases the exposure of the Employer and the business to liability and risk.
